Tammi Smith backs out of jailhouse interview

PHOENIX (CBS5) -

The drama continues surrounding Tammi Smith, the Scottsdale woman at the center of the missing baby Gabriel case.

Smith had agreed to a jailhouse interview Monday to talk about her conviction and first weekend behind bars.

However, shortly after TV crews arrived Smith called off the news conference.

"At some point yesterday she was asked if she would be willing to do an interview with the media," said MCSO officer Chris Hegstrom. "Some time today, when we went back to check, her response was 'I'm not interested.' There was no reason given to me at this time."

It was just a few days ago Smith stood before a superior court judge and apologized for her actions.

She was then sentenced to 30 days in jail and three years probation.

Smith, 40, had been convicted of forgery and conspiracy to commit custodial interference stemming from her role in the disappearance of baby Gabriel, the Valley toddler missing since Dec. 2009.

Smith had tried to adopt Gabriel and convince the child's mother and father to give up their custodial rights.

Prosecutors described Smith as an obsessed woman who would stop at nothing to win custody of the boy.

Now, Smith is telling people she wants to form a foundation to help young mothers with children.

"I don't think she's qualified in any way to do anything like that," said Gabriel's father Logan McQueary. "I don't think that she should be anywhere around counseling or anything like that. I think she should be the one getting counseling."

Gabriel's mother Elizabeth Johnson remains in jail and is set to go on trial this September.

She is charged with child abuse, kidnapping and custodial interference.

Johnson said she killed Gabriel and dumped him in a trash bin, then later changed her story, telling police she gave the baby to a couple in San Antonio.

Smith has said all along that she did not know Johnson would run off with the boy, and she does not know what happened to him.

Smith has not indicated whether she would like to reschedule the interview.
