Man, 74, in court for shooting dog

MT. AIRY, OH (FOX19) -

A 74-year-old man was in court Thursday for shooting a dog at a the Mt. Airy Dog Park earlier this month.

Robert Marx, 74, is charged with criminal damaging or endangering and discharging firearms.

Police say Marx shot the dog, a 1-year-old pit bull named Bruski, for fighting with his dog on April 2. The animal was taken to a veterinary hospital for treatment, and had to be euthanized.

Police say Marx has a concealed carry permit, but under Ohio law, a dog is considered property, therefore a person can't use a firearm to protect property.

Marx was in court on Thursday, where the judge ruled that he could have his electronic monitoring device removed.  Marx's attorney, Mike Allen, said Marx was a good citizen and not a threat.

Another pretrial hearing was scheduled.
