PHOENIX (CBS5) -

A man at the wheel of a vehicle involved in a head-on crash that killed a 3-year-old boy has pleaded guilty to negligent homicide and one count of aggravated assault.

Edgar Martinez, who was 19 at the time of the crash nearly a year ago, entered his plea in Maricopa County Superior Court on Friday.

He is scheduled to be sentenced Dec. 5 before Judge David Gass.

Martinez was trying to pass another car when he hit head-on with a car carrying Eric Garces and two other children on Oct. 5. Garces died two days later.

Martinez exhibited symptoms of marijuana use, according to a court document.

Eric's family was with him when he died, Phoenix police Sgt. Steve Martos said. Eric had suffered a twisted and stretched spinal cord, court paperwork stated.

The two other children, ages 5 and 11, were hospitalized but survived.

A man in the car with the kids was also hospitalized, Martos said. 

Officials said two people inside Martinez's vehicle were also rushed to local hospitals.

The crash occurred near 31st Avenue and Acoma.

Martinez was initially booked into the Maricopa County Fourth Avenue Jail on four counts of aggravated assault and one count of endangerment.
