AZ prosecutor wants death penalty for some convicted human smugglers

An Arizona prosecutor wants human smugglers who are convicted of murder to be eligible for the death penalty.

Pinal County Attorney Lando Voyles said he is proposing that convicted murderers previously convicted of human smuggling be considered for execution.

According to state law, a person can only receive a death sentence if convicted of first degree murder and jurors find at least one aggravating circumstance associated with the crime.

Arizona currently lists 14 of those circumstances, which include being previously convicted of a serious offense.

Voyles said he wants the list of serious offenses to include human smuggling or participating in or assisting a human smuggling organization.

Experts said adding to the state's death penalty law could put it as risk of being found unconstitutional.
