TUCSON, AZ (Tucson News Now) -

Numerous calls to Tucson Police are transcribed from early New Year's Day when a man drove over three other people on Sunland Vista.  So many calls came in that some of them didn't go through.  The lines were flooded and some had to be put on hold.

But one call that did get through was from one of the first on scene: Patrick Balbastro.

Tucson Police said that a cab dropped off suspect Michael Leday and victim Cindy Burnett in the early hours of New Year's Day.  What sounded like a struggle or an assault on Burnett began, and Patrick Balbastro drove on the scene with his girlfriend in the car.  He called 9-1-1.

In the transcript of what police said was likely that call, Balbastro told the dispatcher, "Yeah she has no clothes on," which likely referred to Burnett.

The dispatcher asked Balbastro if he saw any weapons, to which he responded no.  And then he seemed to address the man that Burnett was with, who police suspect to be Leday, and Balbastro said, "I'm not gonna believe you.  I'm gonna get out right now.  Hold this."  That could have been Balbastro getting out of the car and handing the phone to his girlfriend.

The dispatcher told him to not intervene, but Balbastro did, as he said, "What are you gonna get on me?" which was likely addressed to the suspect, possibly Leday.

And as the dispatcher tried to stop it, "Before I hurt this guy right now," was heard on the phone, and "That's a woman right here."

Undescribable yelling was also in the transcript, which likely signified a scuffle, along with the sound of tires screeching and an engine revving.  Witnesses reported the white Acura running over three people repeatedly.

Leday was tracked to Kansas City where he was arrested.  His charges include two counts of First Degree Murder for the deaths of Balbastro and Burnett.
