TUCSON, AZ (Tucson News Now) -

Two protesters arrested during the height of the Occupy Tucson movement gained a partial victory in court.

Jon McLane and John Cooper were organizers of the homeless activist group, Occupy Public Land, and challenged the City Parks Ordinance in 2012, arguing it violated their freedom of speech.

After two years of litigation, a federal court found on Feb. 24 that while the laws do not violate the Constitution, they might have been unfairly applied in the two protestors' particular case. Tucson District Court Judge Berry said the challenge can proceed along those lines.
