Roommate called to testify against mother accused of killing infant

TOLEDO, OH (Toledo News Now) -

The trial of a young mother accused of murdering her infant son continued in downtown Toledo Thursday.

Several witnesses were called Thursday, including a crime scene investigator and two men who said they paid to have sex with defendant Amanda Bacon.

One of those men said he met with Bacon the evening her son, Avery, was injured. He told the jury that when Bacon got in the car, she mentioned her baby had a cold and her sister would take him to the hospital. The man testified he asked if she wanted to stay with her baby and Amanda said, "no."

The state's key witness, Frank Jones, then took the stand. Jones was Bacon's roommate at the time her son died.

Jones testified that he allowed Amanda and Avery to live with him in exchange for sex with Amanda. Jones told the jury Bacon's only source of income was prostitution.

Prosecutors introduced a pair of children's pajamas into evidence, saying Avery was wearing them the day he was injured.

Jones testified that he returned from a bar the evening Avery was injured to find Amanda screaming. He told the jury he saw Avery fall.

Jones: "I go into my apartment. There's a person screaming, and when I opened up the door - Amanda - I seen the baby leave her hands."

Prosecutor: "How did you react when you saw that?"

Jones: "I was - it just tripped me out. And I was like, puzzled."

Prosecutor: "What did you do?"

Jones: "I ran towards her, and by the time I got to her she had already picked him up."

Jones went on to testify that after Avery was hurt, Amanda left the apartment to have sex with another man. While she was away, Jones says he became worried about Avery and called Amanda, asking her to come back to the apartment.

Jones: "When she got back I told her 'we gotta get the baby to the [expletive] hospital."

Prosecutor: "Did the defendant make any statements to you while you were in the car?"

Jones: "She did"

Prosecutor: "What did she say?"

Jones: "She said 'I [expletive] up, Frank. I [expletive] up, I [expletive] up."

Also on the stand Thursday was a man who said he and his late wife cared for Avery, sometimes for weeks at a time. He said he was shocked and heartbroken to hear the child had been hurt and later died.

The judge expects the trail should be wrapped up and sent to the jury for deliberations next Wednesday or Thursday.
