Dugan said the boy was not booked and was handed over to his parents. His name is not being released because he is a minor.

According to the interim complaint, the boy grabbed a girl on her breast and a fight broke out while a teacher was out of the room. School staff investigated, but didn't report the incident to the police.

Naylor Vice Principal Bernadette Rosthenhausler and Linda Archuleta, a counselor, were arrested earlier on charges of failure to report.

The complaint also said that the victim's mother came to the school and wanted to prosecute. She met with Rosthenhausler and Archuleta, who allegedly told her they were not obligated to report the incident to the police.

Instead, they provided her with the Tucson Police Department's non-emergency phone number.
