A complaint from United States Attorneys is seeking harsher penalties for Tad Cummins, the man who's been arrested for kidnapping Elizabeth Thomas.

The complaint filed late Thursday by U.S. Attorney Jonathan Hardison outlines the relationship between Thomas and Cummins, and claims that because there's clear evidence the two had sexual contact, asks that Cummins be charged with transporting a minor across state lines with the intent to engage in criminal sexual activity.

Thomas and Cummins were found Thursday living in a cabin in a rural area in the north California town of Cecilville.

In his 5-page complaint, Hardison interviewed witnesses about an incident where a student said they walked in on Cummins "romantically" kissing Thomas in school, and how detectives had interviewed both a month and a half before they both disappeared.

Investigators also found that days before kidnapping Thomas, Cummins had refilled his prescription for Cialis, a drug used to treat erectile dysfunction, and Cummins bought women's razors and KY Jelly from that Walmart in Oklahoma days after the kidnapping.

The federal charges are in addition to other charges being filed against Cummins by the states of Tennessee and California.

Cummins is being held by the Siskiyou County Sheriff’s Office without bond. He is awaiting extradition to Tennessee, where he will be charged with sexual contact with a minor and aggravated kidnapping.

California is also charging Cummins with kidnapping and possession of stolen property.
